  BUI (Boating Under the Influence) Season

Sheriff deputies patrolled Castaic lake on Sunday, stopping pleasure boats and other watercrafts asking their drivers to undergo a sobriety test. The stops and patrolling were part of Operation Dry Water, where marine law enforcement cracks down on boating under the influence nationwide during the weekend immediately preceding the Fourth of July holiday. 

Los Angeles County sheriff's deputies on powerboats stopped every third vessel that came past them, the drivers were asked to come aboard a floating checkpoint, then conducted a test to determine whether they were drunk or stoned.  

"Boating under the influence of alcohol is extremely dangerous because boats don't have brakes," said Sheriff's Sgt. Roger Wallace.

"There's a significant increase in correlation between alcohol consumption and boating accidents, and the accidents usually involve very serious or fatal injuries."

According to the U.S. Coast Guard, the use of alcohol was cited as a direct factor in about 17 percent of all recreational boating deaths.

Castaic Lake boat drivers suspected of being drunk are arrested, and then immediately brought to Santa Clarita sheriff's station for booking.

  25 Year Old Man Arrested on Suspicion of Gross Vehicular manslaughter While DUI

Isidro Peralta was arrested Saturday on suspicion of gross vehicular manslaughter, felony hit-and-run, and felony driving under the influence, according to sheriff's Lt. Paula Tokar of the Lancaster station.

A drunken Peralta stopped at a checkpoint in Lancaster with blood on his vehicle, deputies noticed the blood on the bumper and the shattered windshield of his 1996 Ford mustang. Authorities retraced Peralta's route and found a dead man on 10th street West near Avenue J-8.

  Mike Ditka's Son Arrested for DUI

Michale P. Ditka, son of famous Chicago Bears Football Coach, Mike Ditka, was arrested for driving under the influence. Michael denies the charge. "I was not driving a car," said Ditka, 49. "I was parked. The keys weren't even in the ignition. I plan on pleading not guilty." Ditka believes he was unfairly targeted because of his famous last name. "If my name was Joe Smith, this would not have happened." Ditka said.

According to the police report, on April 20 a police officer saw a black Hummer with its headlights om, running in the parking lot of the apartment complex. The officer then saw the Hummer drive into the rear parking lot before turning off its headlights. The officer approached the vehicle and found Ditka and another passenger in the car. The passenger allegedly told police that Ditka had been at the wheel when it had pulled into the parking lot.  The report states that Ditka struggled to perform a field sobriety test. A preliminary breath test allegedly indicated that Ditka's blood alcohol concentration was 0.189 percent, exceeding the legal limit. Ditka was taken to the police station, where he refused to take another breath test and was charged with DUI and released on bail.

"This will create a lot of bad PR," Ditka said. "My dad does not need it. I don't want to create a problem for him. People are now going to ask him a million questions."

  Christina Aguilera Arrested on Suspicion of Public Drunkenness

Christina Aguilera was arrested on suspicion of public drunkenness and released Tuesday morning. Los Angeles County Sheriff's department said they don't plan on seeking criminal charges against Aguilera. Steve Whitmore, the sheriff's department's spokesman, said the arrest will go on her record but the case will not be forwarded to prosecutors. She was taken into custody for her safety and the circumstances don't merit criminal charges. "There will be no court date, and there will be no prosecution," he said. According to deputies, a DUI investigation was initiated after they noticed a motorist who was driving erratically. The driver was arrested on suspicion of DUI. Deputies found Aguilera inside the car, she was described as being "very intoxicated," said a source familiar with the case. Deputies did not believe Aguilera would be able to drive safely on her own and took her into protective custody. Protective custody is imprisonment to protect a person from harming oneself or others.

  Astros FIrst Round Draft Pick Arrested for DUI

Delino DeShields, Jr., first round draft pick of the Houston Astros, was arrested early Sunday morning on suspicion of driving under the influence.  DeShields, 18, was charged with three misdemeanor offenses: DUI, underage possession of alcohol, and driving the wrong way  on a one way street. He was booked into jail and released on bail two hours later. The Astros organization has said they will address the issue at an appropriate time.

  Founder of Ron Jon Surf Shops Arrested for DUI

Ron DiMenna, the founder of Ron Jon Surf Shops, was arrested for driving under the influence after being spotted weaving and nearly hitting another vehicle while in his pick-up truck. According to the police report, DiMenna had trouble walking and slurred his speech. Officers searched his vehicle and found a half full 20-oz can of the high alcohol/energy drink Four Loko. DiMenna refused to submit to a breath or blood test to check his blood-alcohol content level. He was arrested and posted $5,500 bond. DiMenna has two prior DUI arrests and had his driver's license suspended.

  Pro Poker Player Arrested for DUI

Pro poker player, John Racener, was arrested for driving under the influence on Saturday morning. He was stopped around 4:00 a.m. and refused to submit to a breath test. This is Racener's third arrest for drunk driving since 2005.

Racener, 24, won $5.5 million coming in second during the 2010 World Series of Poker Main event last month in Las Vegas. He also placed fourth last week at the World Poker Tour Doyle Brunsom Five Diamond  Classic and earned $232,000.

  Sacramento Kings Coach Arrested for DUI

Mario Elie, assistant coach for the Sacramento Kings basketball team, was arrested for suspicion of driving under the influence in California last Thursday. He was stopped around 1:15 a.m. by California highway patrol for having a broken taillight. The officer detected alcohol and signs of impairment and asked Elie to submit to a series of field sobriety tests. Elie registered a blood alcohol content above 0.08% and was booked on charges of CA DUI.

  Man Suspected of Drunken Driving Causes Four-Car Crash

A man suspected of drunk driving has been arrested after leading Los Angeles County sheriff's deputies on a chase starting in Calabasas. The chase caused a four-car crash where five people were injured including the suspect. According to sherrif's Lt. Andy Ross the suspect was pinned inside the car and "he is still being examined." The four other patients suffered minor to moderate injuries.The crash happened at 8:29 p.m. at 1700 Nordhoff st., near Balboa Boulevard, said Erick Scott of the Los Angeles Fire Department.  

According to California Vehicle Code section 23153 VC, you may be charged with a "DUI with injury" if you injured another person while driving under the influence. This could be charged as either a misdemeanor or a felony depending on the circumstances of the offense, and your criminal history.

  Naked Man Arrested for DUI

Christopher Nicholas Bos crashed his 2002 GMC sport utility vehicle into a 2005 Lexus LS450. Bos then attempted to drive off but crashed into a gate. According to a witness Bos ran off, naked, with his dog. Deputies went to Bos' home and his father allowed them in the house.  Bos was found lying on his bed, incoherent and emotional, with blood smeared on his body and bed sheets. When the EMS team arrived Bos resisted, kicking until a deputy tased him. Bos then spit on an officer while being transported to a local medical center.

Bos was first charged with felony battery on a law enforcement officer, criminal mischief and resisting arrest. The state's attorney general's office recently added misdemeanor DUI and leaving the scene of an accident.

  Reggie Rogers Convicted for 6th DUI

Reggie Rogers' legal woes started back in the late 1980s when he ran a stop sign and crashed into another vehicle, killing 3 teenage passengers. His BAC level was twice the legal limit. He was convicted of negligent homicide, and served one year in prison. Rogers quit the NFL after the 1992 season, and recently was arrested for his 6th DUI. Rogers was sentenced to two years in prison for a October DUI arrest and a November 2008 DUI.

  Man Arrested for DUI While Trying to Steal A Stop Light

Christopher McCollum was arrested for trying to steal a flashing red light from a stop sign unaware that a police car was parked 30 ft. away. The 19 yr.old was driving when he stopped around 1:45 A.M. sunday, got out of his truck and started shaking a sign post. The deputies in the parked police car, heard McCollum on his cell phone tell someone that he was probably going to go to jail for "stealing a stop sign in front of cops." He was charged with a underage DUI, and suspicion of theft.

  The Do's and Don'ts Related to a DUI Stop

Thousands of people are pulled over or stopped at check points every month in Los Angeles County, because the police believe they are driving under the influence of alcohol. This guide discusses the "dos" and "don'ts" of your interaction with law enforcement.

"The Dos Related to a DUI Stop"

If you have no alcohol or illegal contraband in your system when the police pull you over, then cooperate with the police and you will be on your way quickly. If you are or may be under the influence of a controlled substance, then you should attempt to make your interaction with the police as brief as possible. You do not have to perform any field sobriety tests. If the police believe you are intoxicated and ask you to perform a blood or breath test, then you are obligated by law to cooperate with them. When the police pull you over for suspicion of DUI, they are looking to talk to you, so they can smell your breath and hear whether your speech is slurred. Again, make your comments quick and to the point. If you have drank anything, do not get behind the wheel. If you have consumed any alcohol, cooperated with the police, but be very matter of fact and as short as possible.

"The Don'ts Related to a DUI Stop"

Don't admit that you where drinking, or you will immediately be ordered out of your car and asked to perform the field sobriety tests. Don't refuse to complete a chemical test when asked to by the police. If you do, it will be considered a refusal - you will lose your license for 1 year and will be presumed guilty in a court of law. Do not think that you can talk your way out of the situation...you can't. The police (especially the CHP) are trained to build a case against you from the moment they see your car on the road. They are not your friend and are trying to build an air tight case against you. Again, be brief and cooperative and volunteer nothing.

  Drunken Driver Crashes Into Patrol Car

California Highway Patrol officers Raliegh Quinones and Jeremy Tolen were parked behind an unoccupied, disabled SUV on the right shoulder of the freeway, when Lazaro Ramirez drove into the rear of the patrol car at about 65 mph with his full-size pickup truck. The collision caused the patrol car to run into the SUV and then onto oncoming traffic. The patrol car was struck a second time by a Toyota Highlander driven by Elizabeth Retiza. Retiza was unharmed. Ramirez was arrested on suspicion of driving under the influence of alcohol.

  DUI: Field Sobriety Tests Explained

When an officer suspects that a driver may be intoxicated, they may ask the driver to perform a series of voluntary tests. These tests are called field sobriety tests and they include exercises that test one's balance, motor skills, and lucidity.

Some sobriety tests are:

Stand on one foot at a time: An officer will probably be looking for raising of the arms, swaying, hopping, putting the foot down, inability to stand still, body tremors or muscle tension.

Follow the pen (a.k.a: Nystagmus):  An officer places an object, such as a pen, 12 inches away from the driver's face, and moves the object side to side while watching the driver's eyes. The officer will probably look for involuntary jerking or trembling of the eyeball.

The Rhomber Balance test: The driver is asked to tilt his or her head back, close his/her eyes and count 30 seconds silently. An officer will probably look for the inability to stand steady, body or eyelids shaking, opening eyes to maintain balannce, swaying or muscle tension. This also tests a person's "internal clock", which may be slowed with the use of alcohol, or sped up with the use of stimulants.

Walk and turn: The driver takes "heel-to-toe" steps in line then turns and takes the same number of  "heel-to-toe" steps back. The officer will probably check for whether the individual can balance, follow instructions, be coordinated, and start/stop when asked.

Finger to Nose: The driver closes one of his or her eyes, must stand straight with feet together and touch index finger to nose. The officer will probably look for body sway or tremors, eyelid tremors or muscle tension.

Other field sobriety tests are:
- Walk in a straight line
- Touch each finger, one after the other, to thumb
- Count backwards
- Recite or sing the alphabet

The purpose of field sobriety tests are to check an individual's motor skills and "divided attention," a critical skill used while operating a motor vehicle. A breath test is a chemical test to estimate the level of intoxication. Field sobriety tests are voluntary, but refusal to cooperate may result in an automatic arrest.

  Man Driving Mower Arrested for DUI

John Phoshepny was arrested for a California DUI after he left the parking lot of a market and drove down th road. He was driving his mower and it was not equipped with lights. According to police, there was a bottle in a brown paper bag and his breath smelled of alcohol. Phoshepny also staggered and had slurred speech. He was booked on misdemeanor DUI. He has no prior California DUI arrests and he had a driver's license.

Any motorized vehicle and bicycles on public roadways are subject to California DUI laws, and their operators must have a valid driver's license and registration.

  21 Year Old DUI Driver Sentenced for Killing Two Teenagers

Adam Mendoza, 21, has been sentenced to 15 years and 8 months in prison for a drunken driving crash that killed Izzy Raya,18, and Ralphy Naranjo,17. The families of the two victims were allowed to testify on Monday before Mendoza was sentenced. One of the victim's mothers brought his ashes to the trial and asked for justice.

 

According to prosecutors, Mendoza was drunk and high on methamphetamines when his SUV hit a light pole. The light pole fell on the SUV and crushed Raya and Naranjo, who were sitting in the back seat. A 17 year old girl was also in the car, she suffered serious injuries.

  A 23-Year-Old Man Arrested on Suspicion of Assault with a Deadly Weapon and Felony Drunk Driving

A 23-year-old man, Juan Zermano, was arrested on suspicion of assault with a deadly weapon and felony drunk driving after he struck another man with his car outside a party. Police were called to a house party at about 1 a.m. after an argument broke out in the house and then moved outside.

According to police, one of the boys involved in the argument called his brother, Zermano, to pick him up. When Zermano drove away, he made a sudden U-turn, drove up on the curb and struck the victim. Police were already on scene to deal with the argument and were able to witness the assault. The victim was released from the hospital early Sunday with non life-threatening injuries.

California Penal Code 245(a)(1) defines assault with a deadly weapon as an assault that is committed with any type of deadly weapon or by means of force that is likely to cause great bodily injury to another. It is filed as either a misdemeanor or a felony depending on the circumstances.

  26 Year Old Motorist Arrested on Suspicion of Vehicular Manslaughter While Driving Under the Influence

A 17-year-old boy was killed early Saturday morning in Pacoima while riding his bicycle, when a motorist struck him. Shawn Fields, 26, was driving a 2007 Saturn northbound on Laurel Canyon Boulevard when he struck the teenager. The impact threw the victim and his bike across the intersection.  He was transported to Providence Holy Cross Medical Center, where he died from his injuries. According to police, the motorist was arrested on suspicion of vehicular manslaughter while driving under the influence of alcohol.

Gross vehicular manslaughter while DUI is one of the most serious charges someone DUI can face. Someone is charged with this crime if they are driving a motor vehicle in a reckless manner that is significantly more then ordinary negligence, and a person is killed. Penalties can be from probation to ten years of state prison for each person who is killed. It must be proved that the person:

  1. Drove under the influence of an alcoholic beverage or a drug or under the combined influence of an alcoholic beverage and a drug or drove while having a blood alcohol level of 0.08% or higher. And,
  2. While driving that vehicle under the influence of an alcoholic beverage or a drug or under the combined influence of an alcoholic beverage and a drug, the person also committed either a misdemeanor or a driving infraction, or any other lawful act that might cause death; And,
  3. The person committed a misdemeanor or some infraction or lawful act that might cause death with gross negligence; And,
  4. The defendant's grossly negligent conduct caused the death of another person.

  In-Car Breathalyzer for Those Convicted of a DUI

According to MADD, Mothers against drunk driving, the average drunk driver has driven drunk 87 times before a first arrest. Although their license is suspended, three out of four of those individuals with a suspended license still drive. Many are in support of the usage of ignition interlock devices, or in-car breathalyzers, which would require all convicted of a DUI to prove they are sober before the car will start.

The device is about the size of a cell phone. The way it works is that it is wired into the ignition system of a vehicle. An individual convicted of a DUI offense would have to blow into the device in order to start their vehicle. If their Blood-Alcohol Content is considerabale, the vehicle will not start. This would allow offenders to drive to and from work but impair them from driving drunk.

In California within the recent year, the number of 3 time offenders is 310,971, the number of 5 time offenders is 44,210, the number of DUI fatalities is 950, and 31% of all traffic deaths are DUI related. California requires ignition interlocks for all convicted DUI offenders in four counties: Alameda, Los Angeles, Sacramento, and Tulare.

  Under New DUI Law, Repeat Offenders Can Lose Their License for 10 Years

Under a new bill signed Monday, repeat DUI offenders could lose their license for a decade if they have three DUI convictions within 10 years. Currently under California law, three convictions during ten years means a three year loss of a person’s license. The new law, AB 1601, does not take effect until January 1st, 2012.

Assemblyman Jerry Hill, D-San Mateo, is responsible for the bill. He became interested in the issue after reading an article in the San Mateo Times regarding repeat DUI offenders. Governor Arnold Schwarzenegger approved the law and said "This legislation is an important step toward making California's roads safer." Schwarzenegger said in a statement, "Those who have multiple DUI convictions should not be on the road threatening lives."

  Underage DUI: The Zero Tolerance Law

Data found on the total DUI arrests for 2008 show a total of 214,828 DUI arrests in California, and out of those 1,468 were not of the legal drinking age.  Under the "Zero Tolerance Law", anyone under the age of 21 with a Blood Alcohol Content (BAC) of 0.01% or more, will be charged with a DUI. Underage drivers with a BAC of 0.05% or greater could be charged with an underage DUI and a regular DUI and is subject to arrest for a DUI.  On average, to reach a BAC of 0.01% would mean you would have to drink either one 12 ounce beer, one 4 ounce glass of wine, or one 1.25 ounce of liquor. Most likely any one of these could put you over the 0.01% and closer to 0.05% BAC.

If convicted, drivers under 18 years old will loose their license for one year or until they turn 18 years old. A judge may also choose to confiscate the underage driver's vehicle. In all cases the driver will have to pay fines of several thousand dollars, and attend driver's safety and alcohol abuse related classes. Subsequent convictions will lead to harsher penalties.

  Lindsay Lohan back in Custody for Violating her Probation

Lohan's legal problems started in 2007 when she was arrested twice for driving under the influence. She pleaded no contest and agreed to take alcohol education classes, but Lohan found herself back in court when prosecutors alleged she failed to attend the required amount of alcohol education sessions. Lohan believed she was in compliance with the terms of her probation, but in the end Superior Court Judge, Marsha N. Revel, sentenced the actress to 90 days in county jail. Lohan served 13 days in custody and was later released to a rehabilitation program where after 23 days she got out early. Under the terms of Lohan's probation, if she missed a drug test or got a positive result, she could face 30 days in jail.

Lohan admitted last week to failing a drug test, violating her probation. In today's mandatory hearing before Judge Elden Fox, Lohan was issued a bench warrant based on a probation report "indicating a positive test for a controlled substance." The judge said he needed more information from probation officials, before a revocation hearing could be held. He then ordered Lohan into custody without bail and set an October 22nd court date.

When you are accused of violating your probation, a hearing is scheduled where a judge will determine whether or not you have violated your probation. If it is determined that you were in violation of your probation then the probation may be revoked and you could be incarcerated for the remainder of the probation period.   DUI Driver, Driving Wrong Way, Nearly Wreaks Havoc on Freeway

On Saturday, 21-year-old Luis Castro drove his 2001 Volkswagen on the wrong side of the San Diego 405 Freeway. This caused a 2010 Honda CRV to swerve out of Castro's way, straight into a 2006 Ford F-150. Sources say that there was not much damage from the collision. As Castro drove on, a 2006 Nissan Murano was forced to brake and was consequently rear-ended. In an attempt to prevent more collisions, the CHP officers stopped the southbound traffic. Castro was arrested shortly after. Sources say that he had been let out on $10,000 bail in another case, and his license had been suspended during the incident. Castro was arrested on being in possession of a controlled substance and suspicion of driving under the influence.

  Locane,'Cry-Baby' Actress And Mother, Charged with Vehicular Homocide in DUI Case

Famous for her role in the film Cry-Baby, Amy Locane, 38, was charged with second-degree vehicular homocide and third-degree assault by automobile. Locane said herself that she had a couple glasses of wine before she drove her SUV into another car. The impact killed the woman sitting in the passenger seat, and the husband, who was in the driver's seat, was harmed badly and flown to the nearest hospital. Just before the accident, witnesses told officials that she had driven over some mailboxes and had been involved in a hit-and-run. Officials also stated that Locane was slurring and smelled of alcohol. Locane is facing five to ten years in state prison, if convicted.

  DUI For 'Three's Company' Actress Joyce DeWitt

Last July, "Three's Company" actress DeWitt pleaded no contest in her drunk-driving debacle. She was slapped with two misdemeanors: driving while having a 0.08% or higher blood alcohol level and driving under the influence.

She was arrested after she drove past a roadblock at yearly firework show.  There she parked her car and made her way to a uniformed officer on his motorcycle. Her blood alcohol was approximately twice the legal limit at .15%.

DeWitt's will be expected to pay a $510 fine, serve three years of  probation, and enroll in an alcohol-treatment program for nine months.

If you are stopped for a DUI in California, expect the Police officer to take a blood test or breath test to measure your BAC (blood alcohol content). If you are found with a BAC of 0.08% or higher you are determined to be “under the influence” and you will be arrested for DUI. Lindsey Lohan currently wears the SCRAMx alcohol-monitoring ankle bracelet , a $1,500 device, made by AMS. Lindsey's judge was anything but pleased when she learned that Lindsey attended the Cannes Film Festival in France, skipping a court hearing she had last week.

Other celebrities have been forced to wear the device: rapper Eve, and retired basketball player Jayson Williams.

This ankle bracelet can restrict people to their homes. It acts very much like a Breathalyzer does, but rather than using one's breath to check alcohol levels, it traces the alcohol levels every half hour through the perspiration on the skin. If it detects alcohol, then that triggers a chemical reaction in the device, and that information is sent to the company, which then alerts the necessary people.
