  6 Deaths and 182 Suspected DUI Arrests Over The Christmas Weekend

Over the Christmas weekend, six people were killed statewide on the freeways.

There were 182 people arrested in the suspicion of driving under the influence.
This report covers a 60-hour period from 6:01 p.m. Friday to 6 a.m. Monday morning.

  2 Car Collision Causes Death - Driver Suspected of DUI

A two car collision in Westwood that caused a death left a woman imprisoned on suspicion for driving under the influence.

Wilshire Boulevard was closed the morning of December 13, 2011 so that the crash can be investigated which occurred on Wilshire at the San Diego (405) Freeway around 11:15 p.m. Monday December 12, 2011.

The woman now sits in jail waiting to possibly be charged with a DUI.

  Long Beach Fire Captain Convicted for DUI Causing Injury

John David Hines, 39, a Long Beach Fire Department captain was sentenced Tuesday December 6, 2011 after he plead guilty to severely injuring a 47 year old cyclist in Long Beach, California whiledriving under the influence back in April of 2011.

His blood alcohol level was nearly three times the legal limit. He was sentenced to serve 5 years probation and one year in jail and was ordered to pay $102,000 in restitution to the victim.

If Hines were to violate probation at anytime, he would be required to serve four years and four months in state prison.

DUI charges have some serious consequences. The penalties depend on a number of circumstances such as the number of prior DUI convictions; whether there was any injury caused; whether any deaths resulted.

  Man Killed in Drunken Driving Accident

John Eric Tubo was arrested after a drunken driving wreck that killed a man. Tubo was arrested on suspicion of felony drunken driving and manslaughter in the rollover accident at about 7:20 p.m. on Friday.

A 66-year-old man was declared dead at the scene. His identity is being witheld. According to the CHP, another passenger was treated for "major" injuries.

  Former Newport Beach City Atty. Arrested on Suspicion of DUI

David Hunt, former Newport Beach City Atty., was arrested in Newport Beach after he hit a parked car. He was arrested on suspicion of drunk driving, but police refused to release his blood-alcohol level or booking photo.

This is his second arrest in two years. He was arrested in March of 2010 by Santa Ana police on suspicion of domestic violence after an altercation he had at home with his wife and son. No charges were filed in that case, and Hunt kept his job as Newport Beach's city attorney.

He was arrested a short distance from his office on Friday about 7:30 p.m. He declined to comment of Monday. According to court records, no charges have been filed. Hunt was given a field sobriety test at the scene of the crash, then arrested, said Police. He was released on his on recognizance at 2:10 a.m. Saturday.

  6 Children Injured, 2 in Critical Condition after DUI Accident

An alleged drunk driving crash has left 7 people injured, 6 of them children. According to authorities, all have been released from the hospital, except two children who remain hospitalized., one in critical condition.

The driver of the vehicle, Stanesha Allen, was arrested on suspicion of drunk driving. She is the mother of three of the children, foster mother of two, and aunt of one. Although she was arrested, she was kept in the hospital for treatment of injuries.

Allen, 31, had attended a wedding the night before and had picked up the children from a babysitter in the morning. She was on her way home when she lost control of her SUV. The Toyota Sequoia flipped four times, leaving some of the children partially ejected. Two of the children were airlifted to a hospital with critical injuries. The other four and Allen were taken by ambulance.

  Driver in Ferrari Crash Suspected of DUI

Authorities believe the driver of a Ferrari involved in a fatal high-speed crash might have been driving under the influence. The driver of the Ferrari, Vladimir Skvortsov, 24, had two convictions for driving under the influence in 2007 and 2009 and another DUI case pending.

The vehicle was driving at a speed of 90-100 miles per hour when it veered off the road and hit a power pole. It split in half and fell over a 30-foot cliff to the beach. Both the driver and the passenger were ejected. The passenger, Basil Max Price III, died at the scene.

Skvortsov was not the registered owner of the Ferrari, and police are trying to determine why he was driving it and who is the owner. Police are also investigating whether or not Skvortsov had been drinking before the crash.

  Rodney King Jr. Charged With DUI

Rodney King Jr. was stopped by deputies on Tuesday after he was seen committing numerous vehicle violations as he drove. According to deputies, when speaking to King, he appeared to be under the influence and was arrested. He was placed in custody and was later released on $2,500 bail. 

This occurs after a recent appearance King made on VH1's "Celebrity Rehab," where he tried to battle his problem with alcoholism. King is famous because of the infamous videotaped beating by Los Angeles Police in March 1991.

  BUI (Boating Under the Influence) Season

Sheriff deputies patrolled Castaic lake on Sunday, stopping pleasure boats and other watercrafts asking their drivers to undergo a sobriety test. The stops and patrolling were part of Operation Dry Water, where marine law enforcement cracks down on boating under the influence nationwide during the weekend immediately preceding the Fourth of July holiday. 

Los Angeles County sheriff's deputies on powerboats stopped every third vessel that came past them, the drivers were asked to come aboard a floating checkpoint, then conducted a test to determine whether they were drunk or stoned.  

"Boating under the influence of alcohol is extremely dangerous because boats don't have brakes," said Sheriff's Sgt. Roger Wallace.

"There's a significant increase in correlation between alcohol consumption and boating accidents, and the accidents usually involve very serious or fatal injuries."

According to the U.S. Coast Guard, the use of alcohol was cited as a direct factor in about 17 percent of all recreational boating deaths.

Castaic Lake boat drivers suspected of being drunk are arrested, and then immediately brought to Santa Clarita sheriff's station for booking.

  Suspected Drunk Driver Crashes into Gas Station

At 2 a.m. Friday morning a sheriff's deputy noticed a car stopped in an intersection near Newhall Ave. and Sierra highway and attempted to pull it over, but the driver sped off and almost immediately crashed into the gas station, said Joe Efflandt, a spokesman for the L.A. County Sheriff's Department.

"The deputy didn't even have time to initiate a pursuit," he said.

The crash caused the awning to collapse and a small fuel leak and fire. Two people had to be extricated using the jaws of life. The man and woman in the car are described to be in their mid-20s, they were taken to a hospital. It is unknown yet whether alcohol was involved.

  Suspected Drunk Driver Crashes into Group of Bicyclists

A car drove into a group of eleven bicyclists early this morning near the border of Culver City and Los Angeles. The 27-year-old female driver of the car was arrested and investigators were looking into the possibility that she had been driving under the influence, said officer Rosario Herrera of the Los Angeles Police Department.

Some reports from media outlets were suggesting that officers were also looking into whether she might have been texting or been otherwise distracted. Reporters from KABC and KTLA who spoke with officers at the scene said the cyclists may have been stopped in the road under a street light that was not operating, creating especially dark conditions.

"It looked like she was stopping, but she kept going," said one unidentified witness interviewed on television. Another witness said it looked like a bowling ball knocking down pins.

  14 Year Old Girl Dies After Drunk Driver Crashes Into the Vehicle She Was A Passenger In

Early Sunday morning at around 1:15 a.m. a man driving a toyota pick up collided with a Mercedes Benz carrying five people. Four of the victims were 14-15 year old girl and according to Irvine police, 2 of the girls, a 14 and 15 year old, were in very serious condition. The 14 year old victim suffered irreversible brain damage and was being kept on life support.

The pickup driver, Austin Farley, 26, and his passenger were not injured. Farley has a drunk driving history. According to the Orange county courts online database, in 2005, he pleaded guilty to driving with a suspended or revoked license and refusing to submit to a chemical test for DUI. In 2009, he pleaded guilty to driving under the influence and battery on a police officer or emergency worker.

Farley was arrested on suspicion of drunk driving and his bail has been set at $100,000.

  Drunken Driver Tries to Flee after Crashing into a Home

A drunk driver allegedly drove into an occupied house in Compton on Tuesday. The man attempted to flee, but neighborhood residents chased after him and helped arrest him. According to Sgt. Joe Riordan, the driver lost control of his vehicle and crashed into two parked cars and then into a home. The driver was arrested on suspicion of driving under the influence and hit-and-run.

  Avoid the 100 DUI Task Force Increases Efforts on Cinco de Mayo

Los Angeles county law enforcement agencies are expanding efforts today in pursuit of drunken drivers due to Cinco de Mayo. There will be a saturation patrol conducted by LAPD. The Foothill Division, California Highwy Patrol, and Los Angeles County Sheriff's Department are some of the 100 Los Angeles County law enforcement agencies planning on deploying extra patrols as part of the county's Avoid the 100 DUI Task Force. The funds for the patrols come from a grant from the California Office of Traffic Safety. "Drunk driving is simply not acceptable and we will be out in force to protect motorists," said Glendora Police Department Chief Rod Castro, whose department is coordinating the county's Avoid the 100 DUI Task Force. "Drunken drivers pose a significant risk that has resulted in serious injury and death. The financial costs of a crash or an arrest for impaired driving can be life changing and the violater often faces jail time, the loss of their driver's license, higher insurance rates, attorney fees, time away from work and dozens of other expenses."

  25 Year Old Man Arrested on Suspicion of Gross Vehicular manslaughter While DUI

Isidro Peralta was arrested Saturday on suspicion of gross vehicular manslaughter, felony hit-and-run, and felony driving under the influence, according to sheriff's Lt. Paula Tokar of the Lancaster station.

A drunken Peralta stopped at a checkpoint in Lancaster with blood on his vehicle, deputies noticed the blood on the bumper and the shattered windshield of his 1996 Ford mustang. Authorities retraced Peralta's route and found a dead man on 10th street West near Avenue J-8.

  Mike Ditka's Son Arrested for DUI

Michale P. Ditka, son of famous Chicago Bears Football Coach, Mike Ditka, was arrested for driving under the influence. Michael denies the charge. "I was not driving a car," said Ditka, 49. "I was parked. The keys weren't even in the ignition. I plan on pleading not guilty." Ditka believes he was unfairly targeted because of his famous last name. "If my name was Joe Smith, this would not have happened." Ditka said.

According to the police report, on April 20 a police officer saw a black Hummer with its headlights om, running in the parking lot of the apartment complex. The officer then saw the Hummer drive into the rear parking lot before turning off its headlights. The officer approached the vehicle and found Ditka and another passenger in the car. The passenger allegedly told police that Ditka had been at the wheel when it had pulled into the parking lot.  The report states that Ditka struggled to perform a field sobriety test. A preliminary breath test allegedly indicated that Ditka's blood alcohol concentration was 0.189 percent, exceeding the legal limit. Ditka was taken to the police station, where he refused to take another breath test and was charged with DUI and released on bail.

"This will create a lot of bad PR," Ditka said. "My dad does not need it. I don't want to create a problem for him. People are now going to ask him a million questions."

  Was 2010 the Year of the Checkpoints or of the Impounds?

California traffic safety declared 2010 as the "year of the checkpoints," and they were not joking. There were 1,050 state-funded checkpoints during the holidays alone, that is twice as many holiday check points then in fiscal 2009. The purpose of the checkpoints were to find drunken drivers and to ensure public safety, but there was six cars impounded for every one DUI arrest.

There were 17,419 vehicles impounded during the last fiscal year. According to a investigation performed by the California Watch and UC Berkeley, most of those were sober unlicensed illegal immigrants. Under state law, unlicensed motorists or motorists who have had their driving privileges suspended or revoked can have their cars impounded for 30 days. The fees and fines that car owners must pay to retrieve their vehicle often reach more than $1,500. According to the data, police cited 12,867 unlicensed drivers in 2010, illegal immigrants may have accounted for more then 70% of vehicle seizures.

Impounds have become a revenue source for many cities; however, seven California agencies have modified their checkpoint policies to try and reduce impounds.

  Do Breathalyzers Actually Measure Alcohol?

Breathalyzers are made to detect and measure any chemical compound that contains the methyl group in its molecular structure. The problem is that those compounds are not found only in alcohol and some can actually be found on the human breath.

Infrared spectroscopy is a technology commonly used in most breath machines used by law enforcement today. When a breath test is being administered, the  DUI suspect must breath through a tube connected to the machine. A breath sample is then captured in a small sample chamber inside the machine. Then beams of infrared light are shot through the captured breath sample. If there are any methyl compounds in the breath sample they will absorb light from the beams. The more light that is absorbed, the less light reaches sensors at the other end of the chamber. The less light that is detected by those sensors, the higher the blood-alcohol reading.

These breathalyzers are more attractive to government because they are cheap. Instead of using more expensive filters or multiple filters, a lesser number of less-costly filters are used. The machines are then non specific to what compounds they detect. If a person has any of these other compounds on their breath, they will get a falsely high breath test.

According to a study done on 8 men, 69 different compounds were found containing the methyl group. A different study with 29 test subjects found that the "combined expired air comprises at least 102 various organic compounds of endogenous and exogenous origin." Diabetics with low blood sugar can have high levels of acetone, which is detected as alcohol by breathalyzers. Scientific studies have found that people on diets can have reduced blood-sugar levels, causing large amounts of acetone than normally seen in individuals. A smoker's BAC test is likely to read higher then expected because of the compound acetaldehyde. Acetaldehyde is produced in the human body as a by-product in metabolizing consumed alcohol, and eventually passes into the lungs and breath. According to researchers, levels of acetaldehyde in the lungs can be 30 times higher in smokers than in non-smokers. This results in a higher BAC reading. There are also industrial compounds such as paint, glue, gasoline, and thinners that contain methyl group. Simply absorbing these industrial compounds through your skin or inhaling the fumes can cause significant levels of the chemical in your body for hours or even days.

  Christina Aguilera Arrested on Suspicion of Public Drunkenness

Christina Aguilera was arrested on suspicion of public drunkenness and released Tuesday morning. Los Angeles County Sheriff's department said they don't plan on seeking criminal charges against Aguilera. Steve Whitmore, the sheriff's department's spokesman, said the arrest will go on her record but the case will not be forwarded to prosecutors. She was taken into custody for her safety and the circumstances don't merit criminal charges. "There will be no court date, and there will be no prosecution," he said. According to deputies, a DUI investigation was initiated after they noticed a motorist who was driving erratically. The driver was arrested on suspicion of DUI. Deputies found Aguilera inside the car, she was described as being "very intoxicated," said a source familiar with the case. Deputies did not believe Aguilera would be able to drive safely on her own and took her into protective custody. Protective custody is imprisonment to protect a person from harming oneself or others.

  Huntington Beach Ranked No.1 in Alcohol-Related Car Accidents

According to numbers released by the state Office of Traffic Safety, Huntington Beach was ranked No. 1 among California cities of its size in per-capita alcohol-related car accidents in 2009. It is ranked above 55 other cities with a population between 100,000 and 250,000. According to the report a total of 195 people were killed or injured in alcohol-related collisions. "I don't think we knew we were No.1," said Lt. Russell Reinhart. "We knew our numbers were high."

In the first part of 2010, the Huntington Beach officials put together a report on how to address drunk-driving problems in the city. Some strategies were to track the locations where drunk-driving suspects had their last drink and to notify managers who were over-serving customers, or to post the pictures of repeat drunk drivers on the department's Facebook page. One positive outcome of the report was that Huntington police had made 1,558 DUI arrests in 2009, which equaled 1.28% of the city's population. The state average was 0.9%, which showed that Huntington police were being aggressive in fighting DUIs.

  Astros FIrst Round Draft Pick Arrested for DUI

Delino DeShields, Jr., first round draft pick of the Houston Astros, was arrested early Sunday morning on suspicion of driving under the influence.  DeShields, 18, was charged with three misdemeanor offenses: DUI, underage possession of alcohol, and driving the wrong way  on a one way street. He was booked into jail and released on bail two hours later. The Astros organization has said they will address the issue at an appropriate time.

  5 Cyclists Arrested for DUI

Early Thursday a group of 15 bicyclists were spotted riding the wrong way down La Cienega blvd. According to CHP, when one hit a center divider it caused officers to suspect alcohol could be involved. Officers conducted field sobriety tests on the bike riders and arrested 5 of the group. Their bicycles were confiscated. According to the arrest report, none of the cyclist were wearing helmets and few had reflectors on their bikes or clothing. The 5 arrested were between the ages of 18 and 22.

Any motorized vehicle and bicycles on public roadways are subject to California DUI laws, and their operators must have a valid driver's license and registration. The California Vehicle Code states that it is unlawful for any person to ride a bicycle upon a highway while under the influence of alcohol (or drugs). A conviction of violating the California cycling under the influence statute subjects the violator to a base fine of $250.00.

  Founder of Ron Jon Surf Shops Arrested for DUI

Ron DiMenna, the founder of Ron Jon Surf Shops, was arrested for driving under the influence after being spotted weaving and nearly hitting another vehicle while in his pick-up truck. According to the police report, DiMenna had trouble walking and slurred his speech. Officers searched his vehicle and found a half full 20-oz can of the high alcohol/energy drink Four Loko. DiMenna refused to submit to a breath or blood test to check his blood-alcohol content level. He was arrested and posted $5,500 bond. DiMenna has two prior DUI arrests and had his driver's license suspended.
